Montgomery County District Attorney Risa Vetri Ferman and Upper Providence Township Police Chief Donald H. Sherid announce the filing of charges for homicide by vehicle while under the influence, driving under the influence of alcohol and related offenses against twenty-five (25) year old Dustin Jones of Spring City, Chester County.
On July 28, 2009, shortly after 2 am, the Upper Providence Police Department responded to an automobile crash in the front yard of 1058 Lewis Road in Upper Providence Township, Montgomery County. When the police arrived they found the defendant trapped in the driver’s seat of a Chevrolet van. They also found the passenger, Richard Holloway, lying inside the van between the front and rear seats. Holloway was unresponsive and pronounced dead at the scene of the crash.
The defendant was flown to Hahnemann Hospital in Philadelphia. During the course of medical treatment at the hospital, blood was taken from the defendant. Samples of the defendant’s blood were submitted to National Medical Services, Inc. for analysis. National Medical Services determined that the defendant’s blood alcohol concentration was .138% w/v, which is well over the legal limit of .08.
The crash reconstruction determined that the defendant lost control of his vehicle and struck a large tree head-on, while driving at a speed in excess of the 40 m.p.h. posted speed limit. The crash reconstruction also determined that the passenger was thrown forward into the dashboard and windshield of the van as a result of the impact with the tree.
The defendant is scheduled to be arraigned at Magisterial District Judge Benjamin R. Crahalla’s Court at 10 am on August 21, 2009. Judge Crahalla’s Court is located at 133 Level Road, Collegeville.
The case will be prosecuted by Assistant District Attorney Brett D. Buick.
